EB-1 Extraordinary Ability

There are three (3) types of EB-1 petitions:

  • Alien of Extraordinary Ability EB-1(a) ;
  • Outstanding Researcher/Outstanding Professor EB-1(b) ;
  • Managers and Executive Transferees EB-1(c), (with requirements similar to L-1);

EB-1 petition does not require a Labor Certification.

  1. An Alien of Extraordinary Ability, or EB-1(a), classification applies to aliens who can demonstrate that they "have risen to the very top of their field of endeavor.
  2. An "Outstanding Researcher or Professor" EB-1(b) petition is for those who are internationally recognized as outstanding in a particular scientific or scholarly field.
  1. The petitioner must present information that will prove her claims. Such as peer-reviewed presentations at symposia, peer-reviewed articles in scholarly journals, entries in a citation index that cite alien's work as authoritative, any documentation of participation as a reviewer for peer-reviewed scholarly journals, testimonials from scholars describing the alien's work as authoritative.
  2. Recommendation Letters included in the petition and written by either field experts.

  1. Gather Documents;
